No. As of October 2026, Spotloan does not lend in New York; the state is not on Spotloan's 39-state list. The New York Department of Financial Services says payday loans are illegal in New York because they break the state's usury laws: a 16% civil cap for many loans and a 25% criminal usury limit. Credit unions and DFS-licensed lenders are the safer route.

Spotloan is not available in New York
Spotloan's FAQ lists the 39 states where it lends as of October 2026, and New York is not on it. Whether you live in Buffalo, Albany, the Bronx or Long Island, you can't apply for a Spotloan with a New York address.
Some borrowers think about using a New Jersey address, since New Jersey is on Spotloan's list. If you don't live there, that would be misrepresentation on a loan application. It's not a safe workaround, and it can leave you with a loan built on false information. The rest of this page covers what you can do legally, and there is more than you might think.
New York's usury limits, explained
New York sets hard limits on interest. In a 2013 letter and press release, the New York State Department of Financial Services (DFS) spelled them out:
- Civil usury: 16%. Under General Obligations Law section 5-501 and Banking Law section 14-a, certain loans under $250,000 with interest above 16% a year are civil usury and illegal.
- Criminal usury: 25%. DFS said loans made in New York with interest above 25% a year are criminal usury.
DFS said directly that payday loans are illegal in New York because they violate the 25% criminal usury limit. It noted that, counting fees on an annual basis, payday loan rates can reach 400%. It also told debt collectors that trying to collect void or unenforceable debts violates state and federal law.
Against that backdrop, a 490% APR loan has no place in New York. Our estimate for a $600 first Spotloan repaid over 10 biweekly payments is about $772.97 in interest, more than the amount borrowed.
How DFS licenses consumer lenders
Some lenders in New York can legally charge more than 16%. They need a license. DFS's Licensed Lender page quotes Banking Law section 340: no one may engage in the business of making consumer loans of $25,000 or less (or business loans of $50,000 or less) and charge more interest than they could charge without a license, unless they are licensed. DFS manages these licenses through NMLS.
Those licensed lenders still operate inside New York's rules, including the criminal usury limit. In practice, that means fewer high-cost options and more protection for you.
Spotloan works differently. It is licensed by the Lending Commission of the Turtle Mountain Band of Chippewa Indians, not by DFS, and it does not offer loans to New Yorkers. Tribal lenders and state regulators have disagreed over which rules apply in various places. For more on the company itself, read our Spotloan and Ningo Lending explainer.

Where New Yorkers can borrow instead
New York's low caps mean the loans you can legally get will usually cost far less than a Spotloan. Here are realistic options:
Credit unions
Federal credit unions may offer Payday Alternative Loans. Under NCUA rules, PAL I loans run $200–$1,000 for 1–6 months and PAL II loans go up to $2,000 for 1–12 months. The APR cap is 28%, and the application fee can be up to $20. Note that a federal credit union's PAL limit is set by NCUA, while New York's usury rules apply to other lenders.
Licensed lenders and banks
Banks and DFS-licensed lenders offer personal loans that stay within New York law. Approval can be stricter, so ask what credit score and income they look for.
Payment plans and local help
Landlords, utilities and hospitals often agree to payment plans. Nonprofit credit counselors and local community groups may help with emergency bills or budgeting.
Compare offers that follow New York law
Our free form sends one request for $200–$5,000 to lenders in our network. They must follow New York law, so offers in New York may be limited or unavailable, and approval is never guaranteed. Many lenders start with a soft inquiry.
Start your loan requestAlready have a high-rate online loan?
If you took an online loan with a rate far above New York's limits, you have options. DFS's 2013 letter said that attempts to collect on void or unenforceable debts violate state and federal law. You can file a complaint through the DFS portal, which accepts complaints about banks and "other financial service or product."
- Keep copies of your loan agreement, payment history and any collection messages.
- Write down the names and phone numbers of anyone who contacts you.
- Know your rights with collectors; the FTC's debt collection FAQs explain what they can and can't do.
- Talk to a legal aid office or nonprofit credit counselor before you agree to a new payment deal.
Red flags when lenders target New Yorkers
High-cost lenders sometimes market online to New Yorkers anyway. Watch for:
- Any APR above 25% on a consumer loan, or an APR that isn't shown at all.
- A contract that says New York law doesn't apply and points to a tribal or foreign court.
- Payments that are mostly "fees," so your balance barely moves.
- Requests for upfront payments, gift cards or your online banking password.
If a lender claims to be licensed, ask for its license and check it through NMLS, which DFS uses for Licensed Lenders. Our lender legitimacy checklist walks through more warning signs.

Frequently asked questions
Is Spotloan available in New York?
No. As of October 2026, New York is not among the 39 states in Spotloan's FAQ, so New York residents cannot apply for a Spotloan. The official FAQ is the place to check for changes. Because DFS treats payday-style loans as illegal under state usury law, New Yorkers should focus on credit unions, banks and DFS-licensed lenders instead.
Are payday loans legal in New York?
No. The New York Department of Financial Services says payday loans are illegal in New York because they violate the state's criminal usury law, which limits interest to 25% a year. DFS also says many loans above 16% a year are civil usury.
What is the maximum interest rate in New York?
According to DFS, the civil usury cap is 16% a year for certain loans under $250,000, and loans above 25% a year are criminal usury. Lenders licensed by DFS under Banking Law section 340 may charge more than 16% on consumer loans of $25,000 or less, but remain subject to state law.
Can I use a New Jersey address to get a Spotloan?
Only if you actually live in New Jersey. Using an address where you don't live is misrepresentation on a loan application. If you live in New York, look at options that are legally open to New York residents. It is not worth the risk.
What should I do if a high-interest online lender is collecting from me in New York?
Keep your records and file a complaint with DFS. In its 2013 letter, DFS said that trying to collect on void or unenforceable debts violates state and federal law. A legal aid office or nonprofit credit counselor can also help.
What can I use instead of Spotloan in New York?
Ask your creditor for a payment plan, then check a credit union Payday Alternative Loan, capped at 28% APR. Banks and DFS-licensed lenders offer personal loans that follow New York law. Nonprofit credit counselors and local community groups can also help with emergency bills or a budget.
